Cyber High Agreement Terms & ConditionsYou are being provided with a Cyber High application license (the "Software") which has been purchased to educate students. Your use of the software is governed by the following: Copyright. The Software is owned by the Fresno County Office of Education and is protected by the United States Copyright laws and international treaty provisions. Therefore, you must treat the Software like any other copyrighted material (e.g., book or musical recording), except that you may either (a) make one copy of the Software solely for backup or archival purposes, (b) transfer the software to a single hard disk, provided you keep the original solely for backup or archival purposes, or (c) for Software which is considered application software (as opposed to operating system software), provided such software is permanently installed on the hard disk or other storage device of your computer (other than a network server) and you use the computer more than 80% of the time it is in use, then you may also make and use a copy of the software on a portable computer. Any other production of the Software is strictly prohibited. You may not copy any Cyber High written materials unless the user has also acquired a license for the reproduction of the written materials. Other Restrictions. You must not lease, loan or transfer the software in any way. You may only use the software personally on computers owned, leased or used by the District, Agency, Provider, Charter School, Organization, University, Private School, or on a portable or home computer as set forth above. You may not modify, reverse engineer, decompile or disassemble the software. District, Agency, Provider, Charter School, Organization, University, Private School policy. It is the responsibility of the purchasing entity to recognize and adhere to the user restrictions described above. It also important for all employees with access to the software to understand that unauthorized copying exposes the individual and district to civil and in some cases criminal penalties. The institutions have no objection to acquiring software for students and employees needed for instruction through proper channels; you should not engage in unauthorized copying under any circumstances. Release of Liability. The Fresno County Office of Education is not responsible for any incompabilities between software installed in any computer where the Cyber High software will June 19, 2006s not responsible in any way for damages to computers or other equipment that might occur while using Cyber High Software.
